R.M. COURT, HAMILTON.
Yesterday.—(Before Captain Jackson, E.M.)
Picturesque Atlas Company : Bowerman Bros. v. K. Morrison. The K.M. gave judgment in thie case, the evidence of which had been taken last court day. He said he could not look upon the alleged delivery as good, and also that the evidence given by both parties was very contradictory, and further, that the defendant's evidence had not been shaken in crossexamination. He would avail himself of the equity and Rood conscience clause of the R. M. Act, and accordingly give judgment for the defendant, each side to pay their own costs. Mr Hay appeared for the prosecution, and Mr Geo. Omickshank, jun., of Te Awamutu, for the defendant. Breach op By-laws.—A. E. Hobbs was charged on the information of Constable Fnrbes with a breach of the Borough of Hamilton by-laws by shooting a wild duck within the boundary on April 2nd. The defendant pleaded not guilty. Mr I. Coates, Mayor of Hamilton, gave evidence as to the shot being fired within the boundary, and also pointed out the boundaries of the borough on the plan. The defendant, when shown the boundaries, pleaded guiltv, but he had shot the duck, thinking that it was not within the borough boundaries. He was fined 10<, and costs 9a. His Worship rama< keel that the next case would meet with a larger fine.
