Tiik shop of William Gatenby, draper, at Newmarket, was discovered on lire at half-past eight o'clock this morning, when Uio lady assistants opened it. Investigation showed that the shop had been bnrglaiiously opened during the night, and a quantity of poods removed. In the Supreme Court, in the case Ferguson Syndicate Company v. Robert Guy and It. \V. Xorilicroft, His Honour delivered judgment, deciding that the magistrate had power to amend the proceedings by striking out Mr Melvilio's name, but that upon such an amendment being inside the defendants in the Resident Magistrate's Court became the Ferguson Syndicate Company (Limited) and that as they were a compmy registered in Scotland, and having only an agent here, but not a place of business, the Resident .Magistrate's Court had no jurisdiction. Judgment was therefore given for plaintiffs, ordering a writ of prohibition t'.-i issue, restraining fillther proceedings against them in the Resident Magistrate's Court. Costs, lit) !)s for disbursements, were awarded to the plaintilts against the defendant Guy. In the Ferguson Syndicate Company v. Christopher Guy and H. W. Northcroft, judgment followed the judgment in the previous case, and a writ of prohibition was ordered to be issued with costs.
