MR EDWARDS' APPOINTMENT.

In* the name of the Attorney-General, Mr Gully, Crown solicitor, filed in the Supreme Court this morning a statement of the cluiin in the unsa brought to test Air Li. Edwards' right to the privileges and responsibilities of a Supreme Court Judge. The document sets forth that thero were five Supreme Court •Tiufci'S who were paid salaries fixed by the Civil Service List Acts of ISG3 and ISS3, and that the appointment of Mr J5 j wards was not by way of substitution for or succession to any of these five Judges. The statement contends that he has no legal warrant, authority, or right for exercising official functions. The AttorneyGeneral prays that duo process of law may be awarded agiiinst the said Mr B. Howards to make him show hy wlnt i.U'hon'ty he claims to have, use, and enjoy the office of Judge; ttiat the commission might to lie cancelled as vacant and disallowed. Mr Gully has also lodged a motion for fhe removal of the case into the Court of Appeal for decision. The case will be argued in the Appeal Court as soon as those already on the list have been disposed of, probably next week. It is understood thero will bo a full bench, Mr Justice Richmond, who is on holiday, taking part in the argument.
