They say it is clear that no owner, lessee, or tenant of a dwellinghouse outside a school district is eligible as an niector in respect of that qualification only. In the case of a person not being tlio owner, lessee, or tenant of a dwelling - house, but being a parent or guardian or person having the actual custody of any child attending any State school situated within such district, the case is not quite so clear. If the person and children are both resident within the school district, he is undoubtedly qualified both to vote and to be elected, but it resident without the district his right to vote will depend on the question whether the child, in respect of whom he claim* a qualification, h;> ~ a legil right to attend the school. It the child is resident in the school district, the parent, guardian or other person having custody of such child is qualiKed whether residing in the school district or nt, but. if the child lives out of the school district, they are of opinion that the parent or guardian or other person, as i» not qualifier) to vote. As regards temporary absence during the week, that does not deprive the. person of his right to vote for the school district in which his permanent dwelling is situated.
