SoMKUouv has blundered, and a, considerable number of persons who have had the misfortunes to find themselves parties to legal proceedings arc to suffer. It appears that Mr McFarlane has been performing the duties of KM. at Hokitika since February. 1890, and was not gazetted to the appointment till boeember. The KM. Act prorides that all Resident Magistrates shall be appointed by the Governor, whicli of course entails their being gazetted. All the decisions given by him in the interval have been ruled invalid. As a contemporary points out, the KM. himself should have discovered the error. There soems to be only one way out of the dilliculty, and that is to pass a validating Act The fact of Mr McFarlane not having been gazetted could i:ot have lessened his capacity 1.0 adjudicate, so no injustice to suitors would accrue.
