RESIDENT MAGISTRATES' COURT, HAMILTON.
Wednesday.—(Before Captain J ackson, R.M.) Taylor v. Somkuskt.—Claim, £i . r >s. Mi' O'Neill appeared tor defendant. The claim was for a cowl or chimney pot, which had been supplied to defendant some nine months ago, which he refused to pay for, as it did not answer the purpose for which it was erected — viz., to stop the downdraft in a chimney. The evidence of plaintiff, who is a plumber, was taken, and wont to show that tho article in question was constructed -J OO0 ™' ing to dimensions, etc., as given by Mr Somerset, and also that when sent away from Hamilton it was >" Z°™ order. V. Muuro's evidence, which was also taken, with the latter part of Taylor's. The evidence tor the defen dant went to show that the cowl was not a workable one, and not fat for the purpose, and also that he hnd obtamsd one from Auckland, wh ch worked satisfactorily.
