Notice?. TTST A I P A COUNTY. In pursuance and exercise of the powers conferred upon it by " The Counties Act. ISS6," the Council of the County of Waipa has made the following Hy-law for reyiiliiting the conditions on which traction engines may be allowed to along the roads wit'in the County of W.iipa, and this By-law shall come into forao on, and have effect from, the first day of January, 1890. By-law for Rehulatixu the Conditions on* which Traction Endives may Bii Allowed to Pass Along the Roads within the County of Waipa. 1. In this By-law if not inconsistent; with the context "owner" means and includes the owner or owners of every traction ent-itie and any person or persons who may either by hire or by virtue of any agreement made with the owner have acquired the use and control for the tiniu being of any traction engine. " Engine " means any traction engine. "Driver" nißins the person bavins; charge for the time being of any traction engine. "Road" means any road wilhin the County of Waipa. Words importing the singular number incluile i\w plural number and words import in" the plural number include the singular number and words importing the masculine -lender include females. Words referring to any locality d Vrict place corporation person or thim; shall he construed coutribiitively as refv;rring to each locality district placo corporation person or thing to whom or to which the provision is applicable. 2. No owner of any engine shall drive or sutler or cause to be driven such engine upon or over any roml unless and uutil he shall have in addition to the persona employed in working the engine first provided a man (hereinafter called a look-out man) to go before such engine. 3. No person not being the owner shall drive any t:ti»ine upon any road without authority from the owner or person in charge of the engine. 4. No owner driver or person in charge of any engine .shall start or drive such engine upon or over any road unless such look-out man as aforesaid is in attendance as herein provided. 5. Every look-out man shall when the engine ho is appointed to attend is passing upon any road go before the engine at such dis-tince as may from time to time be most convenient in order to enable him to obtain a good view of the road in front of the engine and he shall be careful to ascert-iiu that the road is clear in front of the engine especially before the engine goes round any bend iu the road or through any cutting or over any bridge or alone any narrow road where it would be difficult for any vehicle meeting the engine to pass it and it shall be. his duty to warn any person whom he nny meet either on horseback or driving any horse or other animal or vehicle of tin-; approach of Ihe engine and to give any a."j-is*t;iuuy that may be necessary to any person who may require help owing to'his horse or other animal becoming restive or frightened at the sight of the engine. 6 Every driver of an ermine upon any road shall bo careful so to conduct; the engine in his charge as to cause as little obstruction orannuyance as possible to any person passing along such road and every such driver shall stop the engine if requested so to do by any person who may wish to ride or to drive any horse or other animal or vehicle past the engine whether such person be meeting or overtaking the engine. And for the purpose of requesting any driver of any engine to stop as aforesaid it shall b& sufficient if such person hold up one hand as a signal. 7. No driver shall blow off steam or whistle when any person riding or driving any horse or other animal is approaching near to or passing the engine upon auy road. S. Every driver of an engine upon any road shall stop the engine, if he shall meet any person in any difficulty, owing to any horse or other animal in charge of such person becoming frightened or restive at the sight of the engine. 9. Every driver of any engine upon any road thall unless the look out man reports that the road is clear stop the engine before going round any bend in the road where his view of the road may be obstructed from any cause and before entering upon any cutting or narrow part of the road where it would be difficult for any vehicle meeting an engine to pass it- and such driver shall not proceed until the look-out man reports that tho road is clear. 10. No driver shall leave any engine upon any road in such a position as to frighten or be calculated to frighten horses. 11. Any person who shall commit n breach of this by-law shall be liable to a penalty not exceeding five pounds and in any case where any such breach is a continuing one he shall be liable to a penalty not exceeding tive pounds for every day or part of a day during which such breach shall continue.
