[BV TKLIiORAJ'II— OWN' (JOKTiKSI'OXDEXT. ] Auckland, Wednesday. At the Supremo C.mrt to-day, an iniportimfc case affecting 15 )ards of Health was decided by Justice Gillie-. Tho case was that of the Mount Wellington Road Board v. John N.u-e, brought by the Road Board in their cauacity as the looal Board of Health. The defendant had erected within the Mount Wellington Road Board district works in which he had established or intended to establish the business of bone boiler and tallmv inciter. The defendant had not obtained the consent in writing <>f the plaintiff to establish such business, and plaintiff prayed that a writ of injunction be issued, restraining defendant from carrying on the said business without having first obtained such consent m writing. After hearing tho arguments, His Honour held that the plaintiff s iverc entitled by tho Act to give or withhold their consent to the establishment of offensive trades within their district. The intention of the Legislature was quite evident, and it was a reason a bio moaning ; any other meaning would be much less reasonable, therefore he ordered that a writ of injunction as prayed should be issued against the defendant. He allowed costs 15 guineas, and costs out of pocket. _____
