RESIDENT RESIDENT MAGISTRATE'S COURT HAMILTON.
Wednesday.—(Bdf.>re Captain Jackson ' R.M.) Furious Diiivino.— Police v. 0. A. Davis. Mr C. A. Davis, was charged on the information of Constable Murray with furiously driving a buggy and pair of ponies on SunHay lust. The prosecution went to show that whilst the Hamilton Volunteers were inarching to Church parade, the defendant passed with his buggy and pair, and did negligently run over a small boy. Witnesses wero brought forward, who swore there was negligence on the defendant's part, and that he had taken the whip in his hand and whipped up the ponies, and also that he was sitting nn the wrong side of the buggy. For the defence, Mr Searancke stated that he was in the buggy with Mr Davis ; that they overtook the volunteers, and the ponies became restive at the band, which was playing. A lot of boys were in the road following the company. They both shouted to them to get away, and all but the one boy did, and him they did not see. The defendant had complete control over the horses and never took the whip out of the socket. He was driving very carefully. —Mr Davis, in his evidence, stated he did not see the boy until he was under the pole. The ponies were excited at the music, and he did not use the whip at all. —J. Maguire, one of the volunteers, also gave evidence in support of the defendant.—Case dismissed. CIVIL BUSINESS. ■D. McNicor, v. Katb Whitakkr, _ as executrix in the estate of the lateF. Samuel Teas.—lGs, share of fencing. Judgment for plaintiff. J. McPhehson, Clkkk Waikato County Council v. Thos. Monks, for having an unregistered dog. Judgment reserved.
