Supreme Court. At the Supiemo Court to day, an action foi malicious prosecution was commenced, d,inuge>> being laid at £1000. Tho ease was Thomas Pollock v Frank Foley. Mr Uotter opened the c.iso for the pioscmtion, and stated that on the tenth of September defendant falsely and maliciously appealed before Mr W.iduell and laid an information against the plnmtitf who held ji farm m Waikato, and who in cuiisequence was ailested on a chaise of selhng2i"»bheup, and IS head of cattle as bailee. Inconsequence lie sutfeicd injury, and he had been put to considerable expense, for which ho churned damages of £1000. Defendant denies the allegation. He also demos lie had actt d maliciously in causing Pollock to be arrested. Pollock deposed that he was a farmer. He had only been 1.5 months in the pro\ineo, and pieuously for twentytwo yeais in Ot i#> as a farmer and contiactoi. lie took Tisdall's faun in Waikito. On inching this piovinco ho met Foley.it Mithei sun's Hot"l, Piinces street. In July last he asked Foley if he could lend him £.}OO. He would gi\e him seem ity for s.unu ovei Ins stock, ile wanted money to increase his stock. Foloy consented to lend the money at 8 per cent., and valued the stock at £300. It was agieed to go to th>> faun, and seethe stock. He saw it, and appmently \i is satisfied. While theie ho piopo-ed to attend tho sale at Ohaupo on the following Tuesday. They went and puichasud sheep and cattlo at Buck land's. The leceipts are m Foleys name, as the stock was paid for with Foleys money. His (plaintiff's) man took tho sheep and cattle to his f.um There was no special brand on the cattle. Foley returned to Auckland, and bluntly after they met at the Masonic. Mithii'son made out an agreement in connection with the case, but nothing was absolutely settled. He (plamtifi) subsequently concsponded with Foley respecting the bill of .sale, directing letters to be left in caie of Mi Kidd, Commercial Hotel. Ho s-aw Mi Buckland at Ohanpo, and instiueted him to sell his sheep by Auction. He wrote several times to Foley, but received no answer. The sale took placiand the cattle were sold in Pollock's name, and the sheep in Foley's. Did not receive any proceeds either for cattle or sheep. In consequence of Foloy's iiifoniuitiou, ho was j impnsoned for home tnuo ; then brought up at the Police Court, and lemanded until Friday, then until Saturday, when, as no evidence was offered, he was discharged Witness was put to expense, Mr Bucktaud £1, and fees £5 ."w. He had been much in juied in reputation. The case was not concluded. ___________ __________
