Thompson, on o'ltli, -nd tin* accused went into <i hotel in Kihikihi and offered to stll him a horse foi £2. Thompson bought the horse without looking at it, and when he went out to the <-t ible to look at it, he found it was his (Thompson's) own hoi so th.it lie I), id bought. Thompson how e\er in.ide the accused lefund t'l Y.U, all the money that accused h.id left of the £2. It was aftei looking at the horne, and knowing that it was his own propeity that Thompson I .isked the piusoner for a leteiut ; he did so in order to secure the prisoner. II(> missed n «addlo and bridle and he bought the horse foi the puipose of recovering them. John Coyle, stableman at Mr Andei son's hotel, deposed that he undei stood Thompson to say that lie bought the hoiso knowing at the time it \va.s his own hoive he was buj - ing, and that he did so on puipose to re covet his saddle and bi idle, (which however \vm foi'nd afterwaids in a loose-bo\) Accused said he w.u'dmnk and had no recollection whatevoi of the tiansaetion. The court decided that accused should refund 7s to Thompson, each party to pay his own costs. The case in their opinion hhotild never have come before the court.
