England v. the Batteiy Cinnpany, in which the plaintiff sued defendants for damages for wiongful dismissal, the amount claimed being four weeks wages at 7s per day. Plaintiff had been in the employment of the Batteiy Company for neaily a. year, attending to the tailings plant, and had received his wages monthly, fioni which encumstance he inferred that he was engaged flout month to month, and that instead of being suinmari'v dismissed, as had been the cas-e, he should have had a month's notice. Evidence was given on behalf of defendants to show that it was the custom on the Thames and other goldfielda, as w ell as this, to dischaige peisons emploj'ed in the same capacity as the plaintiff at any time and without prior notice being given. The Bench held that as this was now an established usage plaintiff had no right to look for exceptional treatment. He would therefore non-suit him w ith costs, 2!K. Mr Cuff appeared for plaintiff and Mr Millei for defendants.
