HAMILTON PUBLIC CEMETERIES TRUST." Trustees : Tjik Mayor, Councillors and Burg esses of the Borough of Hamilton. Pursuant to the provisions of the "Cemeteries Act, 1882," the following Bye-law is again published for general information, and public notice is hereby given that the «ud B.yi- law, as recited heieunder, will be hi ought into force bv the trustees of the above-named cemeteiies for the regulation and management of the Hamilton Ccmeteiics on and after Tuesday, the 22nd day of October, ISS4.
Eye-law No. 6. For tho regulation and management of the Hamilton Cemeteries the trustees of the said cemeteries ordain as follows, that is to say :—: — All giaves shall bo opened, filled in, and dressed (if required) by the sexton appointed for that puipose. No grave shall be dug less than 6ft. deep, and no coffin shall be buried less than three feet below the surface of the giound. Giaves shall be sunk to a depth of twelve feet (or less) by permission of the tiu&tecs, and must be paid for at the rate of two shillings and sixpence for each foot below the regulation depth, viz : six feet.
Public Graves. No rights or privileges are allowed in these graves, and any bodies other than fiiendsorrelathos may heiein be inteired by the tiustees, for which the following fees will be chaiged :— Childien Adults over under 12 12 years. years, s. d. s. Private Graves. All rights and pi ivileges are given to the owneis of these graves in perpetuity with exclusive right to bury therein. £ s. d. Monuments, Tombstones, and Fences of Graves. No monument, headstone, tombstone or fence shall I)C elected around or upon any giave, either public oi private, until a plan has been submitted to and approved by the Cemeteries Tiustees, and all fences, mfmoiials, &c., not maintained in decent lepair will be removed by tho Trustees at the cost and risk of those concerned.
Private Plots for Graves may tie Transferred. Any purchaser, executor or duly ap pointed attorney, of any owner of private giave with exclusive right of burial in peipetuity therein, may tiansfer their inteiests in the said private grave to any other pei son upon satisfactory pioof to the Trustees of having proper authority to make such transfer, and upon piodnction of receipt for such piivate grave.
Loss of Original Receipt and Duplicate given for Private Graves. Duplicate receipts for private giaves will be issued to persons having the proper authoiity on application and pay ment of a fee of five shillings. The Register of public and piivate giaves in the Hamilton cemeteries, together with the plan of the buiial grounds, may be seaiched or inspected upon payment of a tec of one shilling. All fees and charges must be paid to the Secietaiy of the Trustees by the person undertaking the funeral or interment, and upon such fees being paid, a warrant, authorising the sexton to bury, will be gn en, and such wairant must be dcliveied to the sexton six working hours, at least, befoie the hour fixed for the funeral, except in cases of emergency, and then upon certificate from a medical officer.
Vaults. Vaults may be constructed within any section secured as a private giave by the owner thereof, but plans must be snbmittedto and approve I of by the Cemeteries Trustees befoic construction. They must be lined throughout in brick or concrete, and tho entrance seciucly fastpned. Coffins placed within vaults must be lined with lead or approved material, securely closed to pi event noxious vapours escaping, and creating a nuisance. The fees for interment in any vault are the same as for other occasions, but the cost of reopening and closing the vault shall be borne by the owner thereof. All vaults in the public cemeteries not maintained in proper order and good repair will be closed by the Trustees, and no further burials shall be allowed theiein. Certificates of death must in all cases be delivered to the sexton by the persons responsible, or the burial will not be permitted, and the oi dors for interment must be lodged with the sexton at least six; working houis pi ior to the hour fixed for the funeral, otherwise a charge of 5s extra will be made. The, following particulars must accompany the order : — Name of deceased, age, denomination, No. of plot chosen, date and hour of funeial, and officiating minister.
Offences. Every person who wantonly or .wilfully destroys, or does, or causes to be done any damage to, any memorial, fence, or other erection, or to any plant, tree, or flower-bed within any of the Hamilton Cemeteries, or to the fences thereof, or wilfully disturbs any persons assembled for the purpose of burying the dead shall, upon conviction thereof, be liable for every such offence to a penalty not exceeding twenty pounds (£2O) or to imprisonment for any period not exceeding three months. The owners of cattle, horses, swine or goats, which shall be found trespassing in any of the Hamilton Cemeteries, shall, for every such offence be liable to a penalty of not less than one pound (£1), nor more than five pounds (£5) in respect of every head of cattle, horses, swine or goats so found trespassing without proof of special damage, and notwithstanding that actual damage cannot be proved or shown.
