At the Hamilton Police Court yesterday, before MrS. T. Seddon, J.l\, Richard Vincent, Charles Vincent, aiul James Quin weie charged, on the information ot (Constable Murray, with having, on the night of the 31st December, or the morning ot the Ist January! wilfully and unlawfully damaged a clo&et and gate on the property ot one John MuCabc, in the oo'onpation of One Thomas Lees, the amount of the damage being £1 10s. The lad Quin pleaded,guilty, and Mr O'Neill who appeared' for the 'brothers Vincent, pleaded not guilty on their behalf. — The learned counsel said before, the,' case proceeded he had au objection to make. In the first place the information,, which was hud under the ,">2nd section of the Malicious Injury to Properties Act, was bad, because it disclosed two offences, and secondly- the allegation that no other remedy was provided sa\ o by that section was incorrect, because section 2.1 expressly provided a penalty for injury to gates. He had a defence on the merits of the case, but he felt bound to take the above objections — Sergt. Mcklovarn, wlio prosecuted, said it was not necessary to uite the section of the statute at all, and ho could not see what the, defence would g.iin by aelay, as the police would of course lay a< fresh information. — The Bench said the information would have to be i dismissed', ,and the ease against the defendant Quin would be atl•jouined.
