Wilson.— Claim, £1 12s, value of four pigs, the property of the plaintiff, alleged to have been shot by the defendant, an employe of Messrs Grice and Parker, on the 18th of May last. Mr Gresham for the plaintiff, and Mr Hesketh for the defendant. The evidence of the plaintiff was to the effect that on the day in question iie saw Wilson shoot tire pigs at Parihakua. He told him not to shoot, but defendant paid no heed to him. He identified the pigs by an ear-mark. Several other natives, who deposed th.it they -Were present, gave evidence. There were several discrepancies in the testimony, more especially as to the sex of the pigs, the manner of their death, &c, but in the main they corroborated one another. For the defence, Geoige Wilsou deposed that two pigs were shot on the 26th, with one shot. Previous to this he had posted notices warning the natives to take their pigs away. The whole of the evidence adduced by the natives was false. Wilson's statement was corroborated by another workman; named Powley, who was with him when the pigs were desti'oyed. It wa& also contended that pigs belonged to Mr ' Walker. In closing the case for the defence, Mr Hesketh commented in strong terms on the nature of the evidence given by plaintiff and his witnesses, which he considered had been made up for the occa-. sion., - - -„ •> < ' .;•' • *T Mr Gresham having , replied, the Bench retired, and on returning into Court, gave judgment for plaintiff for amount.claimed,,witH costs, £5 los 6d: /> •' .
