LATEST AUCKLAND NEWS. [BY TELEGRAPH — OWN CORRESPONDENT.] Auckland, Last Night.
At the Police Court to-day Joseph Bloomfield was committed for trial for breaking into Mr Buller's residence at Epsom, also, for burglary at Morgan's. In the latter case his hat, which he left behind in his flight was identified. The University Senate to-day carried a resolution in favor of immediate engagement of two professors to commence a university at Auckland. The Franklin Election Petition Court, continued at Papakura to-day. After hearing the remainder of the evidence re Sutcliffe's vote, the judges decided that however improperly the name had got on the roll, being ona person couldnot be prevented from voting ; therefore although Sutcliffe's action looked suspicious, yet after Mr Shanaghan's evidence the charge of personation against him could not be sustained. In case of the vote being rejected by the Returning Officer, because the voter had written across the face of it, the judges held that as the Act did uot expressly provide for the writing of the name across the voting paper, that constituted no offence. They took it for granted that the object of this Act was to provide for the secrecy of the ballot, but did not seek to prevent an elector, if he choose, to make known how he voted. Every-day experience too went to show that many people openly proclaimed the manner in which they would vote, and afterwards told how they had voted. The voting paper under notice consequently should have been received. The vote was therefore allowed to Buckland. At a subsequent stage a vote for Harris, which had been rejected because all the Christian names were not struck out, was allowed, making his majority as before. The charges of intimidation proved to be of a trifling character, the elector stating he ha-1 been restrained from A'oting, through being threatened with legal proceedings. The case is not concluded.
