D. Hill v. Lvß\kte was adjourned to next Court day. Htrvrtrni Poiilk.v v. Pikox<jiy Tlhjiiway Bo\hd. — In this case Herr Pohlen conducted his own cause, and Mr E. G. McYlmn (the late member for Wai pa) icpiesented the defendant Board, of which he is the chairman. It would requue the genius of a Bret Harte to accurately set forth the efforts of the plaintiff to make himselt understood, but oui phonetic notes tianscribe as follows : — "My name is Heinrich I'ohlen. A pout twelf months agone, I toook a contecac vrom do Boardt. Ter vars a schvampo vot vais to pc feeldt oop an too maak in de center a leetle coolvcrt," Befoic gutting any fuither, the Clerk of the Court lequebted the plaintiff to pay the hearing fee of two shillings. The plaintiff having succeeded in raising a loan for this amount from Mr Sharratt, the Treasurer of the Defendant Board, the case proceeded ; and the plaintiff went on to set forth how "he deed feeldt oop dat schvamp an deed maak in the center dat leetle cool vert, an he deed do vat it vas de posseeble verke of de ingemeur an de suvfeyieur, an doed poot all de clay in de parrow put Mister McMin vot vais de Chairman of the Poart pay vars dp man vot vood not bay lieem no more hay door/co r/er/er /e york, an he had pecn zo b.idley dreeted, and he vars a boor manu nut vive leetle childer. "' This closed the plaintiffs case, to which the Court listened with exemplary patience. Mr McMinn stated in evidence that the plaintiff had been actually overpaid some nineteen shillings. The work done had been measured by Mr Sharrett and by himself in the presence of the plaintiff. Mr James Sharrett corroborated the evidence of the last witness, and stated that the work had been measured faithfully and fairly. The plaintiff had been actually paid too much lor the work done, certainly seven shillings too much, and by plaintiff's own showing about 19s too much. In giving judgment the Court informed the plaintiff that he had utterly failed to make out any case whatever for the Board to answer and that it wa3 wholly unnecessary for either Mr McMinn or for Mr Sharrett to have given any evidence whatever. The plaintiff was accordingly non-suited and ordered to pay &l 16s costs.
The Southland Yewt complains bitterly that the local saw-mill traffic is being ruined throutrh the continued scarcity of railway trucks, preventing 1 millers from fulfilling orders, which have ultimately to be completed elsewhere. G.
