POLICE COURT.

Hamilton, Monday Sept. 9th, 1878, DIsyUTEb OWNKUSHIP.— FORCIBLE ENTHY. Bernard Charles B^ale appeared on a charge of .forcibly catering on the 6th inst., into the premises of T. G. Hammond at Hamilton, of which the informant was then possessed. Mr O\Ne'll appeared for the informant. Defendant applied for an adjournment till 2 p.m. The Court said it was quite prepared to grant an adjournment, but it would be not till that afternoon, but to a later datev The.icase would? be heard at eleven o'clockon. Tuesday the 17 th inst. The cause o| faking the adjournment to a. .longer date than applied for wntt|jiat there were good reasons tie^h*e Resident Magistrate should 1 nQtSifona^case m which the applicant fQ^.the;"adjpurnment was defendant; * The : Gourt* then read the following extract i from letter a addressed m 1876, by JL)r Beale, to the then Minister of Justice :— " That for some years I have been, I regret to say, on bad terms with the Resident Magistrate, and Mr Searancke has entertained a strong prejudice against me.. That I should not have troubled you with that gentleman's opinion m regard to myself, had his prejudices been confined to his private judgment alone. That Mr Searancke has brought his j prejudices to bear against me during the exercise of his public functions as ' Resident Magistrate." It would be impossible, continued the Court to sit under such circumstances and as the local Justices of the Peace when applied to had positively declined to sit upon the case he had no alternative, than, to adjourn the hearing until the 17th ihst. m order that the services of an unprejudiced R.M, or some other Justices might be obtained. The Court then adjourned.
