BY-LAWS WAIKATO COUNTY.
MADE IN ACCORDANCE WITH CLAUSE 199, OF THE COUNTIES ACT, 1876. To prohibit the Slaughtering of Cattle, Sheep, Goats, or Swine, m such j places within the County as the Council may think proper, and to grant Licenses for Slaughter-houses, fix the fees to be paid to the County Fund for such Licenses, and regulate the Slaughtering of animals therein, m such manner as the Council thinks fit. up OC-sggOo Cr ' Gattie may not be slaugh- Ist. —On and after the First day of May, 1877, no person shall keep aslaughter- _"* ed (tl° ty ** house or place for slaughtering cattle intended for sale, barter or exportation, except such oyn ° l ' house or place by duly Licensed for that purpose m the manner hereinafter provided. Penalty. 2nd —Every person who shall slaughter, or cause to be slaughtered^ any cattle, sheep, or pigs, as aforesaid, m any house or place within the Waikato County, not being a duly Licensed slaughter house or place contrary to the- provisions of these By-laws, shall forfeit and pay the Bum of Five Pounds, for every head of cattle, sheep, or pigs, so slaughtered. 3rd. —Every person desirous of obtaining a License for a slaughter-house, or Power fo grant Weenies. pi aoe for si aughtering cattle, shall ten clear days before the monthly meeting of the Council, give to the Clerk of the Council, a notice m writing of his intention to apply for a License and shall describe m said notice the house or place intended to be Licensed and $he Council (a quorum being present) shall consider such application, and if they find the applicant to be a person of unexceptionable character, and the place proposed to be Licensed m a convenient and desirable situation, they shall grant to such person a License under the hand-of the Clerk of the Council. Licenses to be m force 4th—Every License shall be m force from, the date thereof, until the Thirtieth from date to 30th June, day 0f June next following, and the person to whom the same shall be granted, shall pay o owing. to the Clerk of the Council the sum of Two Shillings and i Sixpence for 7 every such License. Power of Councillors to fc^ —For the purpose of preserving cleanliness m Licensed slaughterhouses, or enter and direct the places, it shall be lawful for any Councillor, and for any Constable authorised by writing cleansing of Slaughter- _n_er the hand of a Councillor, or under the hand of the Clerk of the Council, to visit and inspect any slaughterhouse, or place for slaughtering cattle within the County, and to give such directions concerning the cleansing of such slaughter-house, or place, both within and without as to him shall seem needful. Penalty for neglect. 6th —lf any butcher, or the owner, or occupier of any such slaughter-house or place for slaughtering cattle, shall obstruct or molest such Councillor or Constable m the inspection thereof, or shall refuse or neglect to comply with such directions within a reasonable time, every such person shall upon conviction upon the information of such Councillor or Constable forfeit and pay for every such offence, or neglect,.any sum not exceeding Ten Pounds. Power to Justice, Ac, to 7th —lt shall be lawful for any Justice of the Peace, Inspector of the Police, j enter and search. Inspector of Slaughter-houses, or Councillor duly authorized m writing by a Councillor, to enter at any time any slaughter-house, or place, so Licensed as aforesaid, within the Waikato County where there shall be cause to suspect that stolen cattle have been, or are about to be slaughtered, and to make such search and enquiry therein as may seem necessary for the discovery of the offence and the offender. Penalty for obstructing ®^* —-^very Person who shall obstruct, hinder or prevent, any such Justice, Inspector, or Sub-Inspector of Police, Inspector of Slaughter-houses, Councillor, or Constable, from entering any such Licensed premises for the purpose of such search and enquiry, shall be deemed guilty of a misdemeanour, and shall be dealt with accordingly as m cases of misdemeanour at common law. 9th.—Every person Licensed to slaughter cattle within the County shall keep a B of cSttk sUughS tCr book m the form of Schedule B, wherein he shall enter all cattle slaughtered m his licensed house, or place, showing the date of slaughter, the name of the person from whom purchased, the sex, apparent age, colour, and brands, and every person who shall slaughter cattle without making such entry shall forfeit and pay for every head of cattle so omitted to be entered, a sum not exceeding Five Pounds; „ 10th. —Every keeper of a Licensed slanghter-house shall transmit monthy to the nfcbetl urn c " Clerk of the Conncil a report m writing, containing the particulars above-stated, and shall produce such book for the information of any Justice, Councillor, or duly authorised Constable, whenever he shall be so required. And if any such keeper of a Licensed slaughter-house, or place for slaughtering cattle, shall neglect or fail to keep such book or record, or shall refuse to produce such book or record to any Justice, Councillor, or duly authorised Constable, he shall, for every such offence, forfeit and pay a sum not exceeding Twenty Pounds. Not to extend to persons Uth. —That nothing hereinbefore contained shall extend to any person or persons slaughtering cattle for slaughtering at his or her own residence or farm cattle for his or her own use. their own consumption. 12th.—It shall be lawful for any Councillor, Justice of the Peace, or Power to demand produc- authorised Constable, to demand the skin of any horned or neat cattle or sheep that may tion of skins. have been slaughtered within one month previous to the date of such demand, or a full and satisfactory account to whom such skin has been sold, or m what manner disposed of, and any person who, upon such demand, shall refuse or neglect to produce the skins ' of any such cattle that have been slaughtered, or m case the same cannot be produced, to give a full and satisfactory account of how and m what manner the same have been disposed of, shall, on conviction, forfeit and pay, for every such offence, a sum not exceeding Ten Pounds. Pm™m destroying brands 13th. —And if any person shall cut out burn or otherwise destroy, deface, or liable to penalty. obliterate any brand or ear mark which shall have been on any skin, or shall be m possession of, or shall purchase any such skin from which the brand shall have been cut or burnt or otherwise destroyed or defaced without being able to give a satisfactory account thereof, every such person shall, upon oonviction of every such offence, forfeit and pay a sum not exceeding Ten Pounds. County to fix scale of fees l'4th. —It shall be lawful for the Waikato County Council, from time to time, as to be charged for Cattle occasion may require, to fix a scale of fees to be levied, collected and received, from every slaughtered at a private person or persons who shall take out a License for a private slaughter-honse, or place for ■* * we * slaughtering cattle, and such scale of fees from time to time, to alter, vary, and modify, and such fees shall be recoverable m a summary manner by the Waikato Council, their , Clerk, or any collector for the time being duly appointed or authorised by the said Council, provided always that the amount of fees so to be fixed as aforesaid shall m no Maximum fees. case exceed the sums hereinafter mentioned, viz : —For every ram, wether, ewe, lamb, boar, sow, or pig, One Shilling. For every calf under six months old, One Shilling and Sixpence. For every bull, steer, cow or heifer, Two. Shillings and Sixpence, and shall, upon every alteration, be forthwith published m the Waikato Times newspaper. Hours for slaughter may 15th. —It shall be lawful for the Waikato County Council, if they shall see be prescribed; occasion to do so, to prescribe the hours within which any such cattle shall be slaughtered, and to enforce and regulations so to be made m that behalf by a penalty not exceading Five Pounds.' J 18th. —For the purposes of these By-laws the word " Cattle " (unless otherwise expressly stated) shall be taken to include horned or neat cattle, sheep, goats, and swine, and the Waikato County Council may be represented m any proceedings taken under these By-laws, by the County Chairman, or the Clerk for the time being. SCHEDULE A. Form of License for Slaughtering Cattle m the County of Waikato. We, the Waikato County Council do certify that, by virtue of the authority vested m us m this behalf, Mr. of is hereby authorised to keep a Licensed slaughter-house on his property, situated at and being m the County Waikato; and this License is to remain m force from the date hereof until the 30th day cf June next following.
