Febuuaks 22. (Before W. N. Searancke, Esq. , R. M. ) STEALING PROM HE PEB3OK. Israel Petbrel and Gfeorgo Pethrel were charged with stealing four one pounJ notes from the person of Robert Simpson. on the Ohaugo racecourse, on the Bth m Bt. Mr Hay defended the prisoners. Robert Simpson, sworn, said : He was a laborer, residing at the Swamp Company'sfarm. Mat the prisoners at the racecourse, and asked them to have a drink. They had drinks together, and witness, when he paid foi them, pulled out five one pound notes ; put four and the change back iv my pockets. Soon witness felt sick, and George Pethivl asked him if he would not go and have a sleep, in the ti tree, but he said he would be better walking about, Prisoner insisted that a sleep would be best, and witness went and laid down m the scrub but di I not fall asleep. Israel then came! and witness felt him drawing his hand out of his (witness's) pocket, r Prisoners then went away, and witness missed his money, ' The witness was cross-examined at groa' length, to show that lie had drank with any one after treatinet the prisoners to liquors. Constable Haddook deposed to the arrest of the prisoners and to the eflfeot that George Pethrel was the worse for drink.
