Corday v Bauor : Claim, LI 13a 5d for wages. Defendant acknowledged claim. JuJgmenb for plaiutiif for amount, and costs 7s. H McPherson v Duval : Claim, L 3, for liorso biro. Judgment by default. A judgment summons to be issued forthwith. Harris v Smith and Bastabel : Claim, L 7 13s sd, for goods sold and delivered. The defendant Smith did not appear. Mr McGregor Hay appeared for plaintiff. Ja*es Bastabol, labourer, Hamilton East, deposed — He was '* working mates '* with Smith about two years ago. Smith then dealt with Mr Harris for stores. Ho and Smith divided profits of the work, and sharod and shared alike together; they lived together, and witness paid Smith his share of the " tucker." He obtained some few goods from Mr Harris on Smith's account. Smith was the'mla ■who did the business with Mr Harris, and Smith alone was liable. Robert Harris, storekeeper, Hamilton East, deposed — He knew defendants, and. had supplied them with ratious according to bill of particulars. The goods weio principally obtained by Smith ; Bastnboi obtained some few things. Smith and Bastabel clearly understood that their was x ration account as mates for which both wore liable; he trusted both the defendants, il though Smith, as senior partner of Iho :wo, generally actad for both. Bastabel is.'d sometimes to como for goods.
