Ho and Smith divided profits of the work, and sharod and shared alike together; they lived together, and witness paid Smith his share of the " tucker." He obtained some few goods from Mr Harris on Smith's account. Smith was the'mla ■who did the business with Mr Harris, and Smith alone was liable.
