Wallts-v Hbitbon— Claim, £51 12 6d. Mr Hay appeared for plaintiff. Mr Whitakor for defendant. This claim was for the value of a horie illegally taken possession of and detained by defendant, imd ot'uei' damages incidental llicreon. Goorge llenson sworn, laid — I am inau ger for Mr Thornton. I wai with William Higginson at Mangakawa and Piako on the 2nd November last. Iligginson caught a liorso with saddle and bridle on, upon Mr Taylors land. We took the horse to Turnbulls house. He did not know the horse. 'It was 12 miles from mj place. I roceived a notice demanding the horse and £S. I did m.t return the liorso. Cross examined — I <»avo notice that I had the liorso in my possession to Mr Walker on the-9th November. I did not use tnt liorse. I advertiied him on Nov 20. If I had found the owner I should' nave given him up. J C Wallig sworn, deposed — That ho was a contractor living at Hamilton. In November last I mod a horso, he nai different in colour to what he ia mm, being then iron. grey. New the white hairs have gone and he is nearly black. When I lost tno horse, I went to Turnbulls and heard tkere that Hon6onhad hun. I<lid not go to Hensou because I hnd not time. I value the horso and saddle at £17 10t. I also claim 7s Gd per day for detention sinco Noven.ber 2nd. Other witnesses were called to provo tho finding and -detention of the horse, to speak to tho value, aud that from the description given of the lost liai'so in the advertisement no one would have Imown that the horsa in question was 'the same. Tho jury ultimately gave a \erdict for plaintiff, liorso and saddle, £10. Damages, £10, the lirst £10 to bo repaid, if hone were returned same day. The Court refused to allow costs, as the mattor might have been brought in tho R M Court, tho damages given being £20. Tho remaining caso ot Morris t Beorc, having been arranged out of Court, after tho Court roop, there was no further littmg yesterday, »nd ike Court adjournod.
