National Ba.sk of Nen Zealand t Walter Humb.—TMs case had been called on the previous day. An objection was raised to tho hearing, on the ground that the summons had not been .sewed a sufficient number of days previous to the day of trial. His Honor then reserved judgment, and on Thursdaj decided that sufficient notice had • not been given. The question -of costs was reserved until next court day when the caae will ateo "be gone into, Mr Whitaker appeared for tho Plaintiff and Mr Madden for the Defendant.
