HSIR, — It has been stated that a clerical error was made in the fint iisuo of the Highways Act bj the omission of the words " and second.," from the proviso to the Bth clauie, and that the error would be rectified in future is»ues. I question, however, whether this can be done since the nine error occurs in- the original Bill, and it was read out in Committee, and passed all its stages without correction — from which it would seem that -it is not a mere clerical error capable of correction. The consequence,, of the omission is, that no District is under +he Act (the first part excepted), until a notification to that effect is made by the. Superintendent, for all practical purposes the first part is a repeal clause, and nothing more. % ' I afn told" by 'a member of the Council that he recom mended the Government to take legal advice upon the Bill but it seems this excellent suggestion was not taken. The only safe course left is for the Superintendent to bring all the Districts under the Act by notification. The following is the proviso to the 'Bth clause with the words referred to as omitted inserted in italics — " Provided that existing Districts as hereintofore mentioned, shall immediately jtom and after the passing of this Act come under the operation of the first and tecond parts thereof without any notification by the Superintendent." — I am, &c, ' ' i Richard Cabtwright, Jun. 2,6, Shorthand street, ' 15lh July, 1874
