The Waikato Times. "OMNE SOLUM FORTI PATRIA." TUESDAY, DECEMBER 9, 1873.
A TRANSACTION took place .it Flaruiiton on Saturday last thai cannot fail to be di^hparteniuij to those who look forward to the day when the people of this province shall be sufficiently eduoted and sufficiently broud-ni hided to manage their own local affairs wnh credit to themselves and benefit to trie colony. The transaction we allude to was the sale^ by the bailiff, of the books belon< = 'my to the Kirikiriroa Highway ltourd. It ma) be remembered that two letteiB in reference to this case appeared in our paper, also a bhoit repoit of the proceedings in tue (Join t. Id our coluinis was nlso advertised the day ap|omted to hear appeals, hoin the original rating. Mr Hunt accordingly, on the Uth October* .ippealed ng.iinot tho assessment. On the 18th, a uolice appeared in our columns announcing that an amendid jifrhes^ineni li»i wa^ pu.iied ai a certain jilulc iur iu^tciiuu by the raU-pitUTF, .md we learn
from Mr LVterS 1« tier tut .1 \wit'eu m-j tico was served on eich of die objectors t> the origini I rule lo the effect that an amended rate had been struck. Mr Hunt therefore, had three clear days' notice, before the case came into U>urt, that his cause of complaint was lenioveil. We sue not pi epared to offer legal advice to any Bench, but we have always been given to understand ih.it a Resident Magistrate's Conrtis a oomt of .qu t\ i.itlier than of strict law. If this be so, we are derided 'y <<f opinion that the Court should have dismissed ih" complaint, as its cause v\ <is removed, and the .letion iv consequence of a vexatious character. This much is perfectly clear i>) us, Mr Hunt shou'd be well ashamed of himself f.»r having caused thw evp >nc!i me of pubic money for the gratification of hi-, spleen, and the ratepayers reriaitdy owe him 11 debt, of giatitude. After the decision of the e.ise by the Resident Magistrate appeal against it being impossible, the Board was decidedly wrony; not to have paid the costs entailed and thus saved the washing of the dirty linen of the ratepayers in public. We are not prepared to offer an opinion as to whether the seizure of the books was a legal act or not, but of this we are I clear, that a less objectionable form of procedure could have been pursued, We trust that the disgrace entailed upon any set of people by petty squabbling will jiotbe repeated in this district for I some time to come.
On Saturday the books of the lurikiriroa Highway Board, seized, under warrant from the licaident Magistrate's Court, were sold by the baililF at Hamilton. The bidding was very spirited; they were eventually knocked (low n to Mr Farrell for £13 10s. The whole matter appealed to be looked upon as a joke rather than as a disgrace to everybody concerned. It has been mooted that it would be well to invite the Auckland Cricketers to meet a Waikato team during the Cliri&tmas holidays. We believe that we could produce for their reception an eleven that would cause the exertions of their very best efforts to beit. Let a committee of those interested in our national game be appointed to collect subscriptions to defray expenses and issuo the necessary challenge. We are exceedingly sorry to have to announce the death of Messrs Goodfellow's horse, President. Independent of t he loss to the owners, his death is one to tha whole district ; he was, without doubt, one of the best horses of his class in the colony, and had he lived, and met with a fair amount of support, the breed of horses in the Waikato would have been considerably improved. Wo (HerahlJ are informed that some large stockholders nt Tauranga are going to make regular shipments to Auckland of cattlo und sheep. The first instalment was shipped b} the Southern Cross, mi Saturday last, consisting of 145 fat sheep, weighing on an average, we are told, over 901bs a head. In Australia, -15 to sOlbs a head is a good average for merino sheep. A contemporniy ha 4 , clarified the immigrants on board the Hindostan, which left England on the 26th September for Auckland. Married men with families — Laborers G, engine drivers 2, pl.i-lorer 1, coach smith 1, cabinet-maker 1, farm laborer 1. There was a sitting of the Resident Magistrate's Court at Ngaruawalna yesterday. The Court was occupied the whole day in hearing a case, J. Hob^s v. Moflatt, being an act ion to recover the sum of £17 7s 10d, for timber cut and delivered to defendant. Mr Leary appeared for plaintiff, and Mr Ha} ior defendant. The defendant put in a counter claim which, according to his statement, reduced hid indebtedness to £1 10s, which sum ho paid into Court. Judgment for plaintifl" for £1 18s lOcl, and costs £2 Is.
