, WELLINGTON, November L In the special case, Pritcarthly and Co. v. John McLean and Son, litigation arising out of the stopping of'the Wellington dock contract the Chief Justice held that there was no undertaking on the part .df yhe defendants to order sand and gravel beyond what was required. Counsel for defendants asked for judgment on the claim for £20,000, contending that the effect of Sir Robert Stout’s decision was that the plaintiffs had not a course of action. Motion for judgment was deferred, till. Wednesday next?
