Superintendent's Office) Nelson, April, 1873. PROTECTION is hereby granted, subject to the following conditions, for two years from this date Under the provisions of "The Goldfields Act, 1866," to JaMes OtiVs and Alexandeb Sheabee for a Tramway to be constructed along the east side of Palmerston street, Westport, from Wallabi street to Wakefield street, and tbe said James Olive and Alexander Shearer are hereby authorised, subject to the following conditions, to change tbe Tolls hereinafter specified. 1. Tbe tramway is to be completed, to the satisfaction ■of the Provincial Engineer, by the Thirtieth day of April instant, and must be kept in good working order and repair 'during the whole of tbe term to the satisfaction of the Provincial Engineer. 2. That a properly constructed track shall be run each way every "day, except Sundays, at regular Btated times between the hours of. eight o'clock a.m. and eight o'clock p.m. 3. That a good lamp, properly lighted, shall be carried in front of the truck "When running on dark nights. 4. The toll shall not exceed the following, viz.:—For every passenger, One Shilling •; for! every ton of goods, Four Shillings. B, The Superintendent reserves the right to cancel this protection at any time during tbe said term of three years, , if any of the above conditions are not carried out to bis satisfaction > and in the event of any complaint arising, the Superintendent may suspend ] •operation of this protection until the matter has been in- j quired into and decided upon. 6. Should this protection be cancelled, as provided by clause i 5 hereof, the said tramway I shall become tbe property of the Provincial Government, and the Superintendent shall have the right to immediate possession thereof"; and the said James Olive and Alexander Shearer shall not be entitled to any compensation or payment for the same. 7. The Superintendent to have the right at any time of tak-, ing the tramway at a valuation, to be made in the usual way ; in which case the valuation of the work only to be taken, exclusive of goodwill-. 8. The tramway shall not inter. fere with ordinary traffic along the streets mentioned in tbis protection. 9. This protection shall not interfere with the right <of the Superintendent to cause a tramway or railway to be constructed from Westport to tbe Ninemile, by protection or otherwise. 10. This protection shall not be transferred or assigned without the sanction of the Superintendent. OSWALD CURTIS, Superintendent, j Superintendent's Office, Nelson, April 2, 1873. "OHN ANDERSON is hereby authorised, under the provisions of Section XIII. of "The Goldfields Act, 1166," to keep a Ferry Boat on the Mokihinui River, and charge tolls, until tbe 31st December, 1873, as per schedule, on the following conditions : 1. That a competent Ferryman be always in attendance, with a, good safe boat. 2. That all Government Officers, including road overseers, laborers, and postmen, when on duty, shall be ferried across the said riveT free of charge. This protection shall not be transferred without the sanction of the Superintendent. The Warden of the district shall, on being satisfied that the ferry service is not being conducted in a proper and efficient manner, and in accordance with the above conditions, have power to suspend the operation of this protection until the matter of complaint be removed^ Schedule of Tolis Authorised. s. d.
