WESTPORT WARDEN'S COURT.
Tuesday, December 17. (Before J. Giles, Esq., Warden.) Charles Flannery and party, v. R. Pennefather.—Mr Fisher for "defendant. The parties to the suit were in partners as miners, but complainants now pleaded that the ground occupied by themselves, on Christmas terrace, was worked out and valueless, and tho mining plant thereon of no use to the complainants, and also that the defendant objected to buy from the complainants their interest therein, or sell his own. Upon such plea they claimed that the partnership should be dissolved, the mining plant sold, and the proceeds divided between tho said partners. Mr Fisher pleaded that no sufficient cause bad been shown, nor compliance with Section 65 of tho Act. His client also objected because the ground in question had not been worked out: the complainants merely desiring to shift the plant to other ground, which they considered better, and had in reality refnsed to either buy out his client's interest, or sell their own. Application dismissed. APPLICATIONS. R, Pennefather.—For head water race, two heads, previously abandoned at Deep Creek. Granted on condition that applicant employed one other man. Brandes and party.—Amalgamation of extended claim and double area. Granted conditionally on proper number of men being employed.
