(Before J. Giles, Esq., "Warden.) Tuesday, October 8 . Wilson v. Brewer and Company— Adjourned ease. Application for dissolution of partnership. la this ease, which had been adjourned from last sitting of the Court to permit hearing of objections raised bv fas. M'Gavan, a decree of dissolution was granted, and the plaintiff, James Wilson, was appointed to make a statement of partnership accounts. Costs of adjournment to be paid by M'Gavin. Wall and others v. Galvin and others Mr Fisher for plaintiffs. Complainants as registered holders of a Head Water Race from Melbourne Creek, Addison* Flat, purporting to carry 80 inches of water, complained that the defendants, who were entitled to make use of one fourth of the complement ot water, had taken the whole thereof, and diverted it to their own purposes without the sanction of complainants, whereby the cotnplaiuants claimed to have sustained damages <£s, and applied also for order on defendants to ceaso from further diversion of the water beyond the quantity they were entitled to. Application refused on the ground that the site applied for at the Ngakawhau, was required for township purposes.
