RESIDENT MAGISTRATE COURT.
Tuesday, September 9. (Before J. Giles, Esq., K.M.) Assault.—H. Maguire was charged with assaulting James Whelan on the evening of the 2nd instant. Defendant did not appear. Complainant stated that Maguire had entered his house in a partial state of intoxication, and annoyed him and his wife during their tea time, and on complainant attempting to put him out had assaulted him and also again forcibly entered the promises. As no rebutting evidence was given, prisoner was fined 40a and costs, or in default seven days hard labor. CTVIL CASES. David Max v. Henry Wilson.— Claim for £9 13s 6d. on dishonored |
bill. Defendant did not appear. George Jervis, agent for the plaintiff, proved the debt. Judgment given for amount claimed with costs 14s.
Antonio Thomas v. George White.— Claim for £4 10s. Defendant pleaded not indebted. Plaintiff claimed the amount sued for as balance due on wages for working iu cargo boat on the river, and for watching a boat during v certain night at the Black, water. The exact dates at which such service was rendered, he could not prove. Plaintiff disputed the amount claimed as being in excess of rates of wages paid for boating, and also that he had paid sums to plaintiff, and on his account, in excess of the sum sued for. John Draghicavich proved having received certain money from defendant on account of plaintiff, and Charles Crowle gave evidence as to it being the custom for every hand engaged in the boats to take turn in keeping night watch during floods without extra payment. Judgment given for defendant.
