RESIDENT MAGISTRATE COURT.
Tuesday, September 3. (Before J. Giles, Esq., K.M.) CITIL CASES. "W. Carpenter v. C. Leech.—Claim for £2 7s 3d. Debt admitted. Judgment given for amount claimed and eosta. M'Phadden v. B. Bruen.—Adjourned case. The defendant did not appear. Judgment given for ,£9 17a 4d, the amouut claimed, and costs. Stimpson and Lauiplough v. James Lawlor.—Claim for £5 9s 7d. Defendant did not appear. Warrant granted to compel his attendance. Peter James M'Xenna v. Stockton —Mr Fisher for plaintiff. Judgment summons for £4 Is. Defendant pleaded inability to satisfy the claim by reason of working off an old debt due to Mr Harrison. Had offered to pay £L per week, when the bailiff had presented a distress warrant, but that offer M'Kenna had declined to accept. He was now only able to pay ss. Mr Fisher claimed that an order should be now made to enforce payment ot £1 per week as at first offered. The Court declined to make auy special order, inasmuch as the first offer had been refused, and no evidence of intention to defraud had beau since shown.
Apostels v. Lucas, —Claim for £3 3s work done and performed. No appearance of defendant. Judgment for amount claimed and cost.
Excelsior Co. v. Walter Lavette.— This case bad been adjourned to consider objection raised by the defendant that the last call made was illegal, because trakea with other calls the whole amount would be in excess of the full amount legally due on shares. The Court over-ruled the objection, and gave judgment for the ainouut claimed and cost
