RESIDENT MAGISTRATE COURT.
Monday, Mat' 6. (Before J. Giles, Esq., E.M.) ASSAULT. Eodgers appeared to answer a charge of assault on one Clarke, all Shamrock Lead, Addison's Flat. Prom I the evidence it appeared that a fracas had arisen in consequence of defendant attempting to carry away by force a certain rope lying on complainant's claim. Several witnesses were called to prove the assault, and also to give rebutting evidence as to the dispute having culminated in a fair stand up fight. The weight of the testimony being in favor of the former, the defendant was fined £4 and costs. —♦ WESTPOET WARDEN'S COUET, Monday, May 6. (Before J. Giles, Esq., "Warden.) Lamplough, Cochrane, and M'Enroe v. Eodgers.—Claim for £l2 5s 9d, or return of goods alleged to be illegally detained. Tlaintiffs claimed that certain goods" forming part of the working gear of a claim transferred to them as security for moneys owing by defendant and others had been illegally detained, Evidence, written and oral, was given as to the transfer, and the subsequent application for, and granting of protection for the claim in the names of the plaintiffs. The list of articles claimed was not embodied in a schedule to the agreement for transfer of the property, and defendant pleaded that he had not relinquished his share for the benefit of three creditors only; and that he had never relinquished posse* sion of the articles claimed, which were now the property of his creditors, he being insolvent. Judgment for plaintiffs for goods to the value of £3 Bs. The same to be returned forthwith or the value paid by defendant.
