RESIDENT MAGISTRATE COURT.

Monday, March 11. (Before J. Giles, Esq.-, R.M.) Olive and Crowle v. Towing Track Company. — Claim for £63 14s 7d, balance of account on contracts entered into by the plaintiffs for the Towing Track Company. It was objected that the work was not completed according to certain specifications. The plaintiffs deposed that they had done the work agreed upon as near as possible to specifications. Mr O'Conor, who was appointed by the company to oversee the work under the specifications, said that he had refused to pass the work because it was not completed. He had, on behalf of the company, offered to pass the work if certain improvements were made, or allow the contractors £3O and complete the work at the risk of the company for the balance He also ofibred to leave it to arbitration as to what the cost of the required improvement would be, and pay the bakmce> if any, to the plaintiffs. These offers were refused. Messrs Hughes aud Powell and Mr Burns gave corroborative evidence. Judgment reserved till to-morrow.

Scott and Wilkie.—Plaintiff let a boat to defendants on term?, When the boat was returned plaintiff had to pay £ls 15s for repairs anil the supply of gear lost while the bba't was in plaintiff's possession. The conditions for letting the boat were - £\b was to be paid for rent of boat, and it was to be returned in as good order and condition as when let to the de. fendanfs. Mr Eteneveaux surveyed the boat before it'was delivered over to defendants, arid repaired it when returned by them. Judgment for plaintiff with costs. This Day. Olive and Crowle v. Towing TracJt Company. At the opening of the Court his Worship, in the case of Olive and Crowle v. Buller Towing Track Co., remarked that it was one for arbitration ; and that the company in their offers to the plaintiffs seemed to have acted very fairly.. Judgment for plaintiff's £35, 'each party to pay their Own costs.
