WHEREAS by " The Immigration and Public Works A 1 Amendment Act, 1871," it is araon;---. other things enacted, that the Minist' v for Public Works may receive apphY: - tions from the owners or lessees <.! works for the supply of water on Gobi Fields, for mining and other purposes-, or from other persons interested .i •. such works about to be constrictor, for advances of money to aid in t:i<construction, extension, or improvement of such works ; and by the s.p i Act it is further enacted that the w'\-\ Minister may make Eegulations. prf. scribing tne mode of making and -t!.o form of such application, and for proceeding on yuch application, as in the said Act mentioned : And whereas it, is expedient that Eegulations should be made for the purposes in the said Act mentioned: Now therefore, I, the \ Honorable John Davies Qrmond, the Mmistet' for Public Works, in pursuauce anil exercise of the authority vested in nw by the said Act, do hereby make thn Eegulations set forth in the Schedule hereto, prescribing the mode of making andthe form oi application for ad vances of money to aid in the construction of works for the supply of water on Gold Eields, and for proceeding on su a application.
SCHEDULE. 1. Persons desirous * of obtainin] advances of money for the time specified shall make application in writing to the Warden of the District or this Agent duly appointed in that beh;:ir' for the Province or District in whic the intended works are to be construe; - ed, and such application shall state(l.) The names and descriptioi of the applicants, or if th y be a Company registei. d under any Act of the Ger - ral Assembly, then the reg - tered particulars thereof. (2.) The names of the Engines and Manager of the enter" prise. (3.) The general description cl the water race or races, darm , reservoirs, or other work?* proposed to be constructed together with duly attestsi copies of the certificate hi certificates of title to the water or ground; the quantity of water intended to bo conveyed or stored; the length of the race or races ; size of reservoirs or dams ; the maximum rate propose to be charged for the watc ; the nature and extent of tl auriferous ground proposed to be supplied with water. (4.) The estimated cost of the enterprise. (5.) The proposed capital. (6.) The interests, if any, affected by the diversion or storage of the water to be dealt with. (7.) The amount of money pro posed to be borrowed, whirl-, must not exceed one-third of the estimated cost of the construction of the works. 2. With the application the app!'cant shall forward to the Warden or agent a receipt from the Receiver oi Land Eevenue of the District for the. amount of 2-3- per cent, upon the money proposed to be borrowed. 3. Immediately after any application shall have been finally decided upon, the deposit thereon will be i;e paid, except so much as may bo retained under authority of the Minister for covering the cost of the inquiry made in accordance with the provisions of the Act. 4. The projectors of any enterprise to which money may be advanced shal . before the issue of any loan to them, give to the Minister a valid Hen oi mortgage to cover the amount of lorm over the works and property propose c! to be constructed ; and such lien or mortgage shall be registered in tin Warden's Court of the district, and shall be prepared at the expense < f the projectors. 5. No money shall be paid towai cl 1 «the construction of any water rue. , dam, or reservoir unless the projectors oi the same shall have duly registered themselves under the Mining Companies Limited Liability Act or the 3 oint Stock Companies Act. 6. The rate of interest to be paid b, the projectors of any enterprise coining under these Regulations shall be seven (7) pounds per centum per annum, payable quarterly from the date of the advance. 7. The capital sum to be repaid out; of the profits of the enterprise in the same proportion a* the amount 0 money advanced by the Government bears to the paid-.ip capital of tho Company. W.
