HEREAS by " The luunigr- / tion and Public Works A t Amendment Act, 1871," it is amonj;- i other things enacted, that the Minim < y for Public Works may receive applic; - tions from the owners or lessees of works for the supply of water ou Gold Eields, for mining and other purpose.--, or from other persons interested i . such works about to be constracte. , for advances of money to aid in the construction, extension, ov improvement of such works ; and by the sir i Act it is further enacted that the sni I Minister may make Regulations prescribing tne mode of making and the form of such application, and for proceeding on such application, as in tho said Act mentioned : And whereas it is expedient that Regulations should be made for the purposes in the said Act mentioned: Now therefore, I, the Honorable John Davies Ormond, tho Minister for Public Works, in pursuance ami exercise of the authority vested in nvi Regulations set forth in the Schedule hereto, prescribing the mode of making and _the form ot application for advances of money to aid in the construction of works for the supply of water on Gold PieldSj and for proceeding on such application. SCHEDULE. 1. Persons desirous of obtaining advances of money for the time specified shall make application in writing to the Warden of the District or the Agent duly appointed in that behalf for the Province or District in whic the intended works are to be constructed, and such application shall state—(l.) The names and description of tho applicants, or if th y be a Company register, d under any Act of the Geo - ral Assembly, then the reg » tered particulars thereof. (2.) The names of the Engine* v and Manager of the enterprise. (3.) The general description ct the water race or races, dams, reservoirs, or other work-: proposed to he constructed together with duly attested copies of the certificate m certificates of title to the water or ground ; the quan - tity of water intended to be conveyed or stored; the length of the race or races ; size of reservoirs or dams : tho maximum rate proposeto bo charged for the watei ; the nature and extent of tl. auriferous ground propose d to be supplied with water. (4.) The estimated cost of the enterprise. (5.) The proposed capital. (6.) The interests, if any, affected by the diversion or storage of the water to be dealt with. (7.) The amount of money pro posed to be borrowed, which must not exceed one-third of the estimated cost of thoconstruction of the works. 2. With the application the appl : - cant shall forward to the Warden or agent a receipt from the Receiver ot Land Revenue of the District for the amount of 2\ per cent, upon the money proposed to be borrowed. 3. Immediately after any application shall have been finally decided upon, the deposit thereon will be repaid, except so much as may be retained under authority of the Minister for covering the cost of the inquiry made in accordance with the provisions of the Act. 4. The projectors of any enterprise to which monoy may be advanced shall, before the issue of any loan to them, give to the Minister a valid lien or mortgage to cover the amount of loan over tho works and property proposed to be constructed ; and such lien or mortgage shall bo registered in the. Warden's Court of the district, and shall be prepared at the expense of the projectors. 5. No money shall bo paid towards the construction of any water raci , dam, or reservoir unless the projectors of tho same shall have duly registered themselves under the Mining Companies Limited Liability Act or the Joint Stock Companies Act. 6. The rate of interest to be paid by the projectors of any enterprise coming under these Regulations shall be seven (7) pounds per centum per annum, payable quarterly from the date of the advance. 7. The capital sum to be repaid out of tho profits of the enterprise in the same proportion as the amount o money advanced by the Government bears to the paid- ip capital of the Company. W.
