Fields, for mining and other purpose*, or from other persons interested i such works about to be constructor for advances of money to aid hit', construction, extension, or improve 1 - ment of such works ; and by the sa: Act it is further enacted that the said Minister may make Regulations prescribing the mode of making and the form of such application, and for pro ceeding on such application, as in the said Act mentioned : And whereas it is expedient that Regulations should be made for the purposes in the sail! Act mentioned: Now therefore, 1, the Honorab 1 .; John Davies Ormond, the Ministsv for Public Works, in pursuance a;> I exercise of the authority vested in m ; by the said Act, do hereby make the Regulations set forth in the Schedule hereto, prescribing the mode of making and the form ot application for adv.i:.ces of money to aid in the construction of works for the supply of water an Gold Fields, and for pi oceeding on such application. SCHEDULE. 1. Persons desirous of obtaining advances of money for the time specified shall make application in writing to the Warden of the District or the Agent duly appointed in that behalf for the Province or District in whic-'i the intended works are to be construt j ed, and such application shall state--(1.) The names and descriptions of the applicants, or if th<-y be a Company register*u under any Act of the General Assembly, then the regi * tered particulars thereof. (2.) The names of the Engine'.," and Manager of the enterprise. (3.) The general description of the water race or races, dams. pooonub, or othor vrurkß proposed to be constructed, together with duly attested copies of the certificate <>r certificates of title to the water or ground ; the quan tity of water intended to be conveyed or stored; the length of the race or races ■ size of reservoirs or dams ; the maximum rate propose" to be charged for the water; the nature and extent of the auriferous ground proposed to be supplied with water. (4.) The estimated cost of the enterprise. (5.) The proposed capital. ((?.) The interests, if any, affected by the diversion or storage of the water to be dealt wit h. (7.) The amount of money pro posed to be borrowed, whir l " must not exceed one-third of the estimated cost of tin; construction of the works. 2. With the application the appi - cant shall forward to the Warden oi agent a receipt from the Receiver oi Land Revenue of the District for the amount of 2|- per cent, upon tinmoney proposed to be borrowed. 3. Immediately after any application shall have been finally decide upon, the deposit thereon will be n paid, except so much as may ho v< tained under authority of the Ministt i for covering the cost of the inquii made in accordance with the provisions of the Act. 4. The projectors of any enterprise to which money may be advanced sha 1 before the issue of any loan to thtnv give to the Minister a valid lien t mortgage to cover the amount of lon over the works and property pi'opostto be constructed ; and such lien o mortgage shall be registered in i! Warden's Court of the district, an shall bo prepared at the expense < I the projectors. 5. No money shall be paid towai d the construction of any water rai ■ . dam, or reservoir unless the projects ot the same shall have duly registers, themselves under the Mining Con: panies Limited Liability Act or tb ■ Joint Stock Companies Act. 6.
