RESIDENT MAGISTRATE COURT.

Friday, December 8. (Before J. Giles, Esq., R.M.) BREACH OE LICENSING ORDINANCE. Timothy Sheahan, of the Nelson Hotel, Westporr, was charged upou the information of Agenore Dupuis with having unlawfully having kept a light burning in the bar of his licensed house between the hours of two and three a.m., on the 26th November. Mr Pitt appeared for the defendant. The informant asked for a postponement in order to retain counsel. His Worship said that he must proceed with the case. The information having been read, Mr Pitt said that he was prepared to admit the complaint as its stood, and then proceeded to plead certain mitigating cicumstances. His Worship said that if Mr Pitt intended putting forward any palliating circumstances, he should have to examine the complainant as to whether or not .there were any aggravating circumstances. Mr Pitt then consented to his Worship dealing with the case upon the bare fact contained iu the information. His Worship in giving his decision, said that the full penalty provided by the act was £2O, which penalty was also provided forother infringements of the Liceusing Ordinance. It being tho first complaint of the kind brought against the defendant, so far as he knew, he should inflict a fine of £5 and costs. LICENSES. Renewal of publican's license was f ranted to M. Steel for tho Buller otel, Gladstone street, and to J. K. Sloan for an accommodation house at the Lyell. CIVIL CASES. Charles Lempfert v. Bartholemew Dougharty,—Claim for £4 16s lOd. Judgment for plaintiff by default in tho amount claimed and costs. T. N. King v. Morris Connolly.—

Claim for £2 lis 2d. The plaintiff proved the service of* summons personally npou the defendant on Monday, the 4th instant, by Walter Abernethy, who handed it to Connolly in his (plaintiff's) presence. The defendant did not appear, and his Worship gave judgment for the plaintiff in the amount claimed and costs.
