Kenny v, Flannagan. Amount claimed, £3 6s, the value of a pair of earrings, which (he plaintiff had entrusted to the •deTenQa'nt for safe keeping.

Mr Shapter appeared for the defendant, who pleaded hot indebted., Plaintiff stated: I gave the earrings to the defendant for safe keeping. When I gave them to the defendant, she asked me to make a present'o'f them to her. I retused. She then asked me to sell them to her, which I also refused. She then said what would I say if she kept them. I said 1 did not think she would do so. I was going to the court at the time to see the magistrate. I paid over £3 for the earrings to a Mrs Clarke at Addison's Fiat. When I went to Mrs Fiannagan for the earrings she denied having received them. I had taken a few glasses of drink at that time.

John M'Laughlin stated: I saw plaintiff give defendant the earrings and case when she was going to the court. After defendant got the earrings she went into the inner room. Miss Todd was present at the time. Mrs Liddle stated that the plaintiff gave defendant the earrings. When plaintiff came from the court she asked defendant for them. The latter replied that she had lost three onions out of her pocket, and, if Bke had the earrings, she might have lost them also.

Mrs Flannagan, the defendant, stated: I remember when Miss Kenny came into my house. She was in a state that I would not like to mention. She said Mrs Liddle told her to como. I did not wish to be in the house when she was there.

Mr Shapter addressed the court for the defence.

His Worship gave judgment for the plaintiff, and ordered that the earnings be restored, or the money paid within twenty-four hours.
