Mr Shapter for defendant. Fresh evidence, not then procnratt was taken, and the case was heard w a jury. The case had reference to l water right, and lasted until late in 1 evening, when the assessors made* order that defendant should gauge & water coming down the. creek into 1 dam, and let down a similar quanti? below to the defendant.
