We have previously referred to the "Land Transfer Act, 1870," as a measure calculated to work very beneficially, and requiring only to be thoroughly understood throughout the Colony, to be fully appreciated. The object of the legislature in passing the statute, was to enable the public to avail themselves of some simple and inexpensive mode of conveying landed estate. The expense in connection with the transfer of real property in this Colony had been found to be so utterly disproportionate to the value of the majority of the holdings, as to practically debar persons from investing in land, so greatly was its value depreciated by the expensive legal process necessary to obtain a title, exceeding in many instances the value of the property to be conveyed. The subjoined table of examples of fees payable under the Act, will enable it to be seen in how simple a manner, aud for how small a fee it is competent for a person to bring his land under its provisions, and subsequently to deal with it in any way he may desire for a greatly reduced charge:— The following examples of the fees payable for bringing land under " The Land Transfer Act, 1870," are published for general information : All lands sold by the Crown after the Act brought into force are registered forthwith, the fees payable being only 2s for registration, and the assurance fee ol in the £ on the value. When the title consists of a grant dated on or subsequent to the 28th December, 1841, and none of the land included therein has been dealt with ; value of land £loo—s. d. Fee for registering transfer or discharge of mortgage or encumbrance, or the transfer or surrender of a lease, ss. The following is an example of the cost of a comparatively large transaction : A man possessed of land of the value of £ISOO, the title to which consists of a grant dated on or subsequent to the 23fch December, 1841, and none of the land included in which has been dealt with, desires to mortgage the same for £IOOO. He finds that he can effect the transaction under the Land Transfer Act upon payment of ;;the following fees: — £ s. d.
