Provided that when from the irregularity of the face of the hill, or from any other difficulty arising from the nature of the ground, the claim cannot be advantageously marked out in accordance with the above regulations, it shall be lawful for the Warden, eitl er after a personal inspection of the ground, or a report on the subject by a Surveyor, to define a base line from which any claim or claims may be marked out, instead of from the face of the hill, to the depth of 1,000 feel, or less, at the discretion of the Warden.
