Agnew, master, sailed from Port Philip Heads on the 15th inst. Sho experienced, in the early part of the passage, variable winds attended by severe Squalls flying all round the compass, and a heavy confused sea. Passed Kent's Group on the 17th inst., weather threatening and barometer falling fast. From that time up to making the land, had a continuation of strong westerly gales. On the 24th inst. made the land, blowing a stroDg gale of wind from S.W. Brought tile ship to wind and stood out to sea, the vessel at. this time pitching b iws under. Made an ofKngof forty miles, and again stood in for the land, and on Thursday, at 10 p.m., anchored off the Steeples. On Friday, the weather threatening and the barometer falling fast, got under way, and again stood out to sea. During the night, the barometer going up, and the weather getting more steady, stood in for the Buller, and on Sunday morning was towed in by the steamer Charles Edward. News has been received that Melbourne is to be the head-quarters of the French steamers iu the Southern seas. Four A.B. seamen, one bandsman, and one stoker deserted from H.M.S. Galatea during her last visit to Melbourne. A rather important case was brought before the Nelson Resident Magistrate on Thursday, concerning the allowance to be made to the crew ol a vessel if retained on her articles during the time the vessel may be undergoing repairs. The plaintiff in this case, named Isbister, sued Mr Paul, the owner of the steamer Murray, for £27 Is, being the cost of his maintenance on shore, while the vessel was undergoing repairs at. Wellington. The plaintiff had been engajed at- £25 a month, besides his provisions on board, and as, while the vessel was undergoing repairs, he was employed about her, he considered himself entitled to be paid for his board, which he was compelled to get on shore, the cook and crew having been discharged. The defendant, endeavored to set up a plea or custom against the claim, but in this he failed; and the Court (N. Edwards, Esq., sitting with the Resident Magistrate) awarded .the plaintiff payment at the rate of 4s 6d a day, and costs. Mr Adams gave notice of appeal.
