The appealed case of Luke and party v. Perry and party was concluded in the District Court yesterday. The appeal was disallowed. It was a remark of the Judge that " the whole thing was a mistake from beginning to end." It was a remark of Mr Button that the framers of New Zealand I G-oldfields Regulations " have not departed from the precedent which they J seem to take, that they will not profit by the example of others." The case is, in fact, prolific of comment, and, if I there is one comment that may be I made more truly than another it is J that the rules and regulations are most imperfect, and entirely inapplicable to j what are proving to be some of the mast important diggings on the West I
Coast. It is simply scandalous that miners should be under the necessity of wasting their time and their means in litigation to prove only the defects of goldfields regulations, and we can j only trust that out of the evil which exists some good will arise by the miners insisting upon the appointment of a Mining Commission, whose duty it will be to review the present code 'of rules, and to amend them so far as to prevent the recurrence of such extraordinary cases as that which was concluded yesterday in the District Court.
