WARDEN'S COURT.
Tuesday 20th Octobeb. (Before J. Giles, Esq., "Warden. G-. H. Brown and party v. Cooney and party. Mr Tyler appeared as counsel for the complainants ; the defendants did not put in an appearance. This was a re-hearing by assessors of an encroachment case decided a little time ago, the object being to get a reduction of the amount (£4O), then awarded as damages to be paid to Cooney and party The assessors appointed were Messrs R. Alcorn, T. Field, H. Pain, and R. Rowlands, and they decided that Cooney and party were entitled to £25 damages, and that the costs of one action was to be paid by plaintiffs, and the costs of the other action to be paid
by defendants. On application being made by Mr Tyler, an order was made for the payment of £2l 15s, out of the £3O paid into Court. The nett result of the two actions is, that Cooney and party receive the sum of £8 5s after all expenses are paid.
