RESIDENT MAGISTRATE'S COURT.
Fhida.y Jtjite 19. (Before J. Giles, Esq., H.M.) ASSAULT R O'Dounell was charged with assaulting R. liayne 011 Sunday night last. Mr Campbell appeared for the complainant, and Mr Tyler for the defence. From the evidence, it appeared that the complainant and his wife, first went into defendant's house, when defendant was absent, and created a disturbance, and were turned out by Messrs Heid, Dale and Holland. On defendant coming down from Addisons, ho went to complainant's house to ask for an explanation, when the latter called him a liar, some other words passed, and the assault complained of was committed. The reason given for Hayne and his wife going to Mrs O'Donnell's place was, that the latter had used her (Mrs Hayne's) name in some quarrel that bad arisen in Mrs O'Donuell's house on the evening previous to the assault. The Magistrate, did not think that he could attach much weight to the defence set up, that provocation had been given, as that had been some time previous to the assault. It seemed that there had been a neighbours quarrel, and on the previous night Mr and Mrs Hayne had trespassed in defendant's house. There was however a remedy in such a case, or if Mrs Hayne or any one else used abusive language to defendant. This was he considered a deliberate assault, and he should fine defendant £3 and costs.
