RESIDENT MAGISTRATE'S COURT.
Thursday, March 12. (Before Gk W. Lighband, Esq., J.P.) Susan Lowe was fined £1 for being drunk and disorderly. WAEDEN'S COUET. Simpson v. Kennedy and others. — This was a case involving an amount of £3 6s 6d for certain timber supplied, in which judgment had been given a few days before for the defendants, but a re-hearing before assessors had been granted to allow of some fresh evidence being brougnt forward. The following gentlemen were selected as assessors : —James Jones, Edmund Twohill, Wm. Hunter and Neil Black. A vast number of witnesses were called on either side, the hearing of the case occupying the Court the whole forenoon, but the actual facts lay in a very small compass. The question at issue mainly turned upon whether the giving to plaintiff a certain list of sizes for timber constituted an order. Plaintiff insisted that it did; and that, moreover, a verbal'order was given by Mr Kennedy."!:, This was contradicted by both Mr Kennedy and Mr J. L. Clarke, who gave the list referred to, and there was a good deal of contradictory swearing on both sides. The assessors dccideded in favor of plaintiff, giving judgment for amount claimed and £5
13s cost?. Against this decision it is the intention of the defendants, Ave believe, to appeal. Hannix v. Williams. —Complainant claimed £lO for the defendant for the defendant unlawfully mining in the plaintiff's dam. Case dismissed. John Blakely v. Arthur Johnston. — For refusing to give up a certain certificate of registration for an extended claim No. 37a. Judgment for plaintiff, and 15s costs; certificate to be given up to plaintiff. JJlrich Starch v. Joseph Waterman. —For refusing to pay plaintiff" the sum of £ls 5s for keeping possession for defendant of section No. 254 for the space of 30 weeks. Case dismissed. The following cases were also dismissed :— John Coldreth v. Roderick Scanlan and Party, Stewart and Parti/ v. Chas. Richter, Johnson and Party v. Nbrrish aud Party.
