An attempt, apparently to romovo Mr Proctor from the Bench, was by defendant's counsel, by applying for all witnesses to be orderod out of Court, Mr Proctor refused to retire, and when put inJhf flie"witness'bQi, he gave liis avidencq** and returned to Bis Wat V'the Bench. • The Bench retired, and in 15 minutes returned, the Magistrate stating that_ they were equally divided on the issue as to facts.
