A SINGULAR CASE.
From Our Own Correspondent. Cartehtok, Wednesday, On the information of H. B. Tuc-j| ker, licensee of the Marquis of manby Hotel, George Wall appeared at the Magistrate's Court, Carterton, ■ yesterday, to answer the charge of I haying committed a breach of the ■ Licensing Act, section 159, in falsely . representing himself as a traveller, i and by such means obtaining alco- , liolic drink during prohibited hours, Tuckor and the barmaid sworo that Wall said he was a traveller from Ponatahi. Defeudantg/vvo evidence <m oath that lie was not, asked wlma ho slopt tlw pmioasaight, and that m asking to bo sawed with a driuk he stated that he belonged to Ponatahi. The Bench was occupied by T. Hutchison, S.M., and T. Proctor, A. Biah, H. R. Bunny, J. Bayliss, and G. W. Deller, Justices or the Peace. An attempt, apparently to romovo Mr Proctor from the Bench, was by defendant's counsel, by applying for all witnesses to be orderod out of Court, Mr Proctor refused to retire, and when put inJhf flie"witness'bQi, he gave liis avidencq** and returned to Bis Wat V'the Bench. • The Bench retired, and in 15 minutes returned, the Magistrate stating that_ they were equally divided on the issue as to facts. Ho dismissed tho caso with costs 23s against informant, Mr Beard was for the informant and Mr Acheson for accused,
