ALLEGED FRAUD.
COHTBAOTOK AND STOREKEEPER. ' In the case J, Graham i\ O'Brien, on resuming at 2 p.m. His Worship said the assignment order was insufficiently stamped. He would allow its introduction on the undertaking that it he duly stamped if payable under these proceedings. The question of notice was argued by Mr Pownall, who held that Mr Mcßae having given a verbal consent to tho assignment, it waß un necessary to produce the notico in writing or evidence of its delivery. The Court was occupied all the aftornoon with argument on legal points. His Worship reserving his decision till this (Saturday) morning. A second information charging O'Brien with fraud, waß dismissed without any evidence being called, on teclmial grounds. After hearing legal argument His Worship said the question as to whether O'Brien was guilty of stealing the money must rest upon the legality of the assignment made. ajL He held that the argument had left jr too much doubt upon the whole matter. It was quito clear that no assignment had been made in the terms of tho Property Law Consolidation Act. The information would therefore he dismissed. A second information was withdrawn by consent of His Worship.
