' MASTERTON.-THURSDAY. [Before His Honor, District Judoi Kettle.] The quarterly sitting of the Masterton District Court was opened to-day, before Mr District Judgo ; Kettle. . ! The following jurymen answered to their names:—Cf. J, Hansen, i Henry Ford, W. Baker Jam-., John Johnson, .Robert Rigg, Alfred Anketell, O.Pragnell.E.E. Gunther, W. C. Perry, , FENCING CIAIJI. ; Frederick Lee v. Hera Te Atu, • Pubara Te Tan, and Tawbiao Te i Tnu, claim £l2O for erecting n fence , ou the boundary of properties between the parties. Mr Pownall, instructed by Mr i Beard, appeared for plaintiff, and Mr Bunny for defendants, i The following jury were empaueli lod: —Davirl Miller (foreman), John i Johnson, John McKenzie, and Wm. Baker, junr. In opening the case Mr Pownall said the claim was for erecting a i fence between properties occupied by the parties and bounded on one side by the Puhoe Block. At the time the fenco was erected the Pahoe block had not become subject to the provisions of the Fencing Act, The , land subsequently became the pro- , perty of tho defendants, and since then the notice had been served on the defendants claiming the half i cost of the fence. It was also alleged ' by the plaintiff, that in 1890 the i defendants had made an agreement to share the cost of the fence. This 1 agreement was made by Puhara Te i Tau, on behalf of himself and the i other defendants." No price had been agreed upon for the fence, but the plaintiff alleges that 20s per chain was a fair price, and it would be shown that even after four years : the fence was worth closo on this amount.
