Mr i Hutchison, S.M., had in March last, lined W, H, Day, of Greytown North, ' for keeping his shop open on Saturday, the day appointed by the | Borough Council for tbehalf-holidiiy, '. and this decision was appealed , against. Mr Skewed, who appeared in ' support of the appeal, submitted ', that " January next," where used in : Section 9 of tho Act, must he held to i mean January, 18f6. He also urged , that the Borough Council meeting, , at which the special resolution was ] passed, was improperly called. ; Mr Chapman, for the respondent, \ argued that tho statute must be ( taken to speak from the date of tho Royal assent, and contended that the Council meeting was legally called. , His Honor remarked that ho did , not think there was much in the first point raised by Mr Skerrett, . with regard to the. Act being inoperative until January, IS9G, and said as the matter was ono of general importance, he would give a written , judgment,
